This course continues the problem presentation and solving begun in Part 1. In this hour, three (3) problems are introduced for the students to work out. Each problem presents a different, common issue in the calculation of a Social Security [Disability] offset in workers’’ compensation cases. In problem 5, the course pays particular attention to confusion created by forms promulgated by the Division of Workers’ Compensation, as it potentially violates procedures prescribed by case law (the “Prater” dilemma). This course enables the attorney to manage carefully the calculation of benefits in order to provide more specialized legal advice to clients.
